Evidently I can't reply beyond this point, so I'll just add that I'd argue that the first amendment rights of the waitress are also inolved. This was her experience, and in a common understanding of who owns what, it belongs to her. The only issue is whether or not the use of the receipt is a significant enough breach to outshine the obvious. But I think I'll withdraw and let you hang the waitress, so I can get on with the day...
