Precedence is not clean on the matter. Past practice of an enlarged definition of recess has been allowed to stand, so wiping away the current President's choices would be what I'd call a partisan low blow. I hope the Supremes include the history of this practice in their deliberations, before deciding whether or not to dismantle it.
