OK, you could win on the facts - but for me the issue really is the new collection practices finding ways to achieve the same powerful threat as does debtors prison - albeit not strictly debtor's prison.
I think that the result for some people is going to be that they would not be in jail if not for the money owed; with a subset of that being those for whom there was no way to stop the process and avoid the scary world of jail.
It's like banning war, but not rumors of war.
